SAM Terms of Use
Invited Test Program
Last updated: September 10, 2026
Test-phase draft, under legal review. These terms apply only to the invited test group and will be replaced by the reviewed version.
Agreement and scope
These Terms of Use (“Terms”) govern your access to SAM's invited test program, including its application, account features, record connections, text and voice features, and related services made available to you (collectively, the “Service”). They form an agreement between you and SAM (“we,” “us” or “our”).
By selecting “I agree,” or completing another action that expressly identifies these Terms for acceptance, you agree to them. If you do not agree, do not create an account, connect records or use the Service. An invitation alone is not acceptance of these Terms or authorization to process records.
The test program is available only to people we invite and authorize in the United States and its territories. An invitation is personal and does not authorize public distribution, resale, institutional deployment or access by another family. Participation does not entitle you to any future version or commercial offering.
Our Privacy Notice, available at [PRIVACY_NOTICE_URL], explains how we collect, use, disclose, retain and protect personal information. Accepting these Terms does not replace any separate permission or consent required for health-data processing, connecting a health system, making records available for answers, activating voice or sharing information.
Eligibility and authority over the child's information
You must be at least 18 years old and legally capable of entering into these Terms. You must also have the legal authority to access, provide and authorize the particular information you use with SAM, whether as a parent, legal guardian or caregiver acting under valid authorization.
The child is the subject of the records, not an account holder or intended independent user of this test program. Do not create an account for a child or allow a child to use your account independently. These Terms govern our relationship with you; they do not purport to waive the child's independent rights.
A family relationship, payment for care or possession of a record does not by itself establish unrestricted authority over all of the child's information. You must respect applicable confidentiality restrictions, court orders, custody arrangements and limits on another person's access.
You must stop any use for which you no longer have authority and promptly tell us about a change that materially affects account access or permissions. This includes a relevant court order, withdrawn caregiver permission, disputed authority or a transition in who controls the child's information under applicable law. We may request reasonably necessary verification or restrict access while an authority issue is resolved. SAM does not decide custody, guardianship or other legal disputes.
What SAM does
SAM helps authorized adults organize a child's health, developmental, behavioral, therapy and related educational records, ask questions about authorized records, and prepare for appointments and follow-up conversations.
Each participating family uses a separate family environment hosted on AWS. This is a hosted service, not a promise that records exist only on your phone or computer. Authorized service providers may process information as described in the Privacy Notice and the permissions you provide.
Features may be added, limited, changed or withdrawn during testing. Only features actually made available to your account are included in your participation; demonstrations, roadmaps and discussions of possible features are not delivery commitments.
No medical care or emergency monitoring
SAM is not a physician, nurse, therapist or other licensed clinician, and use of the Service does not create a clinician-patient relationship with us. SAM does not diagnose, prescribe, select treatment, change medication or replace the judgment of the child's treating professionals.
SAM is not an emergency service, continuous monitoring service or substitute for direct supervision. Do not rely on it to detect urgent symptoms, identify every risk, contact a clinician or summon assistance. If someone may need immediate help, call 911 or the applicable local emergency number.
Do not start, stop or change medication, treatment or another care plan based only on a SAM answer. Confirm clinical questions with the appropriate treating professional, and do not delay seeking care because of something SAM says or fails to say.
Accounts and authorized access
Provide accurate account information and keep your credentials private. Use your own authorized account rather than sharing a password, impersonating another caregiver or allowing someone to act through your identity.
Protect devices used to access SAM, including downloaded records, browser-stored information and exported files. Notify us promptly if you believe an account, device or credential has been compromised. We may require additional verification, end sessions or temporarily restrict access to protect accounts or records.
Any invitation or permission you give another caregiver must remain within your own legal authority and the access controls made available by the Service. Access to a family environment does not automatically confer ownership of the child's information or the right to see another user's private account information or conversations.
Connecting, importing and authorizing records
You decide whether to connect a supported health system or provide records directly. By completing a connection's authorization process, you direct SAM to request information within the read-only permissions granted by that connection.
SAM's health-system connections do not authorize SAM to write to a provider's chart, create clinical orders or amend the provider's records. A correction or annotation made in SAM does not change the original provider record. Ask the originating provider about corrections to its own records.
Importing records and authorizing their use in answers are separate steps. Fetched records are held in private staging until the person authorized to control record use for the family approves the versions that may be made available for answers. A later import does not automatically replace that approved snapshot.
Record availability and freshness depend on the health system, the information it exposes, the permissions and validity of the connection, and when SAM requests an update. SAM does not guarantee that it has every record, receives changes immediately or always uses the newest information in the provider's system. Check source dates, connection status and the record versions you have authorized.
You must not connect an account, upload a record or approve its use unless you have the necessary rights and permissions. Do not bypass restrictions imposed by the health system, another authorized person or applicable law.
Disconnecting, withdrawing permission and deleting data
These are different actions:
Disconnecting a health system stops future retrieval through that connection. It does not, by itself, erase information already received or remove records from the health system.
Withdrawing SAM's permission to use records in answers disables future answer-path reads under that permission. It does not retract an answer already delivered or remove information already downloaded, exported or shared.
Requesting deletion asks SAM to remove retained information within the request's scope, subject to the retention provisions below and applicable law.
Use the available account controls or ask the person who invited you to the test program to direct your request to SAM. We may verify your identity and authority before acting, particularly if a request affects another authorized person or involves disputed access rights. A provider may also offer its own controls for revoking a connection; those controls and SAM's controls may have different effects.
Stopping use of the application or closing a browser window is not, by itself, a deletion request. Keep any records you need before asking us to delete them.
Answers, sources and limitations
SAM uses automated systems, including artificial intelligence, to produce answers, summaries, transcriptions and other outputs. Outputs can be incomplete, outdated, misleading or incorrect, even when they appear confident or include a citation.
Record-based answers are restricted by the record versions you have authorized. Source references help you inspect the basis of an answer; they do not establish that the source itself is accurate, that a statement is clinically correct or that no relevant information is missing. An answer based on a saved snapshot may differ from information later added to the record.
Review important outputs against their sources. Pay particular attention to medication names, doses, frequency, allergies, dates, numbers, attribution, conditional instructions and conflicts between records. If an answer is unsupported or inconsistent, do not rely on it; consult the original record and the appropriate professional.
SAM is designed to decline or qualify unsupported record-based answers, but no automated safeguard is a guarantee against error. Generated content is not an official provider record, a new clinical instruction or proof that a professional has agreed to a proposed action.
Voice features
Voice features may capture audio, create a transcript and generate spoken responses when you activate them. The applicable voice notice and controls explain the processing and retention associated with those features. Microphone access or acceptance of these Terms is not blanket consent to record other people.
Before capturing another person's voice or conversation, provide any required notice and obtain any consent required by law and the circumstances. Do not use SAM to record a clinical visit or other conversation unless the feature supports that use and you have the necessary permissions.
Speech recognition and synthesis may omit, alter or mispronounce information. Review the visible text and supporting record for anything consequential, and do not assume that an interrupted or failed spoken response was complete. Turning off the microphone does not, by itself, delete audio or transcripts already processed.
Your content and our limited permission to process it
“Your Content” means records, files, messages, observations, corrections and other information you or an authorized person provide or direct SAM to obtain.
As between you and SAM, you and the relevant rights holders retain your respective rights in Your Content. We do not claim ownership of the child's underlying records merely because they are processed by SAM, and these Terms do not transfer rights belonging to the child, a provider or another person.
You grant us a limited, nonexclusive permission to receive, host, copy, organize, process, retrieve, display and transmit Your Content as necessary to provide and secure the Service in accordance with your instructions, the Privacy Notice and applicable permissions. We may exercise that permission through service providers performing those functions for us.
This permission is not a blanket authorization to sell health information, use it for unrelated advertising or train unrelated general-purpose models. An additional purpose falls outside the permission granted here and requires its own lawful basis and any separately required specific notice, authorization or consent; it cannot be enabled merely by changing these Terms. Withdrawal and deletion are governed by the relevant sections of these Terms and the Privacy Notice.
You may use and share outputs made available to you, subject to the rights of other people and applicable law. We do not promise that AI-generated outputs are unique, eligible for copyright protection or free of third-party rights.
Privacy, service providers and external services
We use service providers for functions such as hosting, security, speech recognition, language generation, speech synthesis and retrieval of published information. Depending on the feature, processing may include relevant record content, questions, audio, transcripts, account information or technical data, as disclosed in the Privacy Notice and applicable notices.
Our use of a service provider does not remove our responsibilities under applicable law or our stated privacy commitments. Accepting these Terms does not require you to accept undisclosed processor terms as a substitute for our own obligations.
A health-system portal, website or other service you access directly may have its own terms and privacy practices. SAM does not control those services, guarantee their availability or represent that they endorse SAM. A connection may be interrupted or withdrawn by the health system independently of SAM.
Export, retention and deletion
You may export information made available to you through the Service's export function or request assistance through the person who invited you to the test program. Export remains subject to verification of identity and authority, other people's rights and applicable law.
An export is not a guarantee that every source system's information has been obtained, that another system will accept the file or that it contains SAM's software, security keys, internal security records or another user's private information. Keep the export secure and check that it contains the information you need.
We handle deletion requests in accordance with the Privacy Notice and applicable law. Limited information may need to be retained for legal obligations, valid legal holds, security incidents, fraud prevention or the establishment, exercise or defense of legal claims. Backup copies may remain until they expire under the retention schedule disclosed in the Privacy Notice. Retained information remains subject to applicable access and use restrictions and is not kept indefinitely merely because an account was closed.
Retention for these limited purposes does not authorize using records for new answers after the relevant answer-use permission has been withdrawn. Our retention and recovery processes must preserve that restriction.
Deletion from SAM does not delete a provider's original records, recall a copy you or another person exported, or erase information held independently by another party. Requests affecting information processed by our service providers are handled through the applicable deletion process.
Completed deletion from active service may be irreversible. Do not rely on a backup or support request to recover information after deletion, and do not use SAM as your only copy of essential records.
Permitted use and restrictions
You may use the Service only for its intended, lawful family-record and appointment-preparation purposes, within your invitation and permissions.
You must not:
- Access another family's information or attempt to bypass staging, promotion, authorization or other security controls.
- Upload information unlawfully, impersonate another person or misrepresent your authority over records.
- Use the Service to harm, harass, exploit or unlawfully monitor another person.
- Introduce malicious code, interfere with the Service or perform unauthorized security testing.
- Extract personal information in bulk, resell access or use the Service for unrelated commercial data collection.
- Present a SAM output as a clinician's diagnosis, prescription or approval when it is not.
- Copy or reverse engineer SAM's proprietary software except where expressly authorized or permitted by law notwithstanding this restriction.
Report a suspected vulnerability or unintended disclosure through the person who invited you to the test program rather than accessing more information than necessary to identify the issue. Do not include sensitive records or credentials in an ordinary message.
SAM's software and feedback
We and our licensors retain the rights in the Service's software, interface, branding and other proprietary materials, excluding Your Content. Subject to these Terms, we give you a limited, personal, nonexclusive, nontransferable right to use the Service during your authorized participation.
You may voluntarily give us suggestions or feedback. We may use those ideas to improve SAM without owing compensation, but this permission does not turn health records, personal information or private conversations into unrestricted product-development or training material. Applicable third-party and open-source rights remain unaffected.
Test-program charges and changes
These Terms do not authorize charges, subscriptions or automatic renewal. Any paid offering requires separate disclosure of its price, billing, cancellation and refund terms and your affirmative agreement before a charge is imposed.
The Service is being tested and may contain defects, incomplete features or interruptions. Participation does not create an uptime guarantee, service-level agreement, guaranteed support response or commitment to retain a feature or continue the test program.
We may change or discontinue test features. For a planned closure of the test program, we will provide reasonable advance notice and a practical opportunity to request an export, unless a legal requirement or urgent security or safety concern prevents that notice or access. Discontinuation does not eliminate applicable privacy, retention or deletion obligations.
Suspension and termination
You may stop using SAM at any time. To close an account, withdraw a permission, disconnect a provider or request deletion, use the relevant controls or request assistance through the person who invited you to the test program; those actions have different effects as described above.
We may suspend or end access for a material breach of these Terms, unauthorized access, unresolved authority disputes, security or safety risks, legal requirements or the end of the test program. Where reasonable and appropriate, we will explain the restriction and give you an opportunity to address the issue. We may act immediately when necessary to protect people, records or the Service.
Suspension does not automatically waive your applicable rights to access, export or request deletion of information. If normal controls are unavailable, ask the person who invited you to direct your request to SAM so we can consider it through an appropriate verification process. Retention and deletion obligations continue after access ends.
Warranty disclaimer
To the extent permitted by applicable law, the test Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose and noninfringement, and do not warrant uninterrupted operation, error-free outputs or suitability for medical decision-making.
This disclaimer does not override express obligations in these Terms, applicable privacy commitments or rights and protections that cannot lawfully be excluded. It does not excuse unlawful conduct or eliminate duties imposed by applicable law.
Limits on liability
To the extent permitted by applicable law, SAM will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from use of the Service. These exclusions do not apply to our fraud, willful misconduct or gross negligence, or to liability that applicable law does not allow us to exclude or limit. They do not waive nonwaivable rights relating to personal information, consumer protection, death or personal injury.
The limitations apply only to the extent enforceable in the relevant jurisdiction. Nothing in these Terms requires you to assume liability for SAM's own unlawful conduct or purports to bind a child to a waiver of independent rights.
Governing law and disputes
Subject to any mandatory laws that protect you where you reside, these Terms are governed by the laws of the State of Delaware, without applying conflict-of-law rules that would require a different jurisdiction's laws.
Unless mandatory law provides otherwise, disputes may be brought in the state or federal courts located in Delaware that have competent jurisdiction, and each party consents to those courts' jurisdiction. Nothing in this provision prevents a claim in an available small-claims court, a complaint to a regulator or the exercise of a right that cannot lawfully be waived.
We encourage you to raise a concern through the person who invited you to the test program so we can try to resolve it. Doing so is not a condition that prevents urgent relief or causes you to lose a statutory filing deadline. These Terms do not require binding arbitration or waive class-action rights.
Changes to these Terms
We may revise these Terms as the test program changes. We will identify the revised version and its effective date and provide notice through the Service or an appropriate account contact method.
For material changes, we will provide advance notice where reasonably practicable and obtain renewed acceptance when required. A change applies prospectively and does not retroactively enlarge permission to use or disclose information previously collected.
Updating these Terms is not a substitute for any separate consent required for a new data purpose, recipient or feature. If you do not accept revised Terms, you may stop using the Service and request export or deletion as described above, subject to applicable law.
General provisions
These Terms and any supplemental service terms you expressly accept constitute the agreement governing your use of SAM's test program. They do not override mandatory rights, required consents or applicable commitments in the Privacy Notice.
You may not transfer your account or these Terms to another person without our authorization, except as permitted by law. We may assign these Terms in connection with a merger, reorganization, transfer of the Service or operation of law, subject to applicable notice, consent and privacy requirements. An assignment does not itself expand permitted uses of Your Content.
If a provision is unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions will continue to apply to the extent lawful. Failure to enforce a provision on one occasion is not a waiver of future enforcement.
Provisions that by their nature must continue after termination, including applicable content rights, privacy obligations, retention/deletion duties, liability provisions and dispute provisions, survive only to the extent relevant and lawful. Termination does not create a new or broader right to retain or use records.
